Meta Platforms Inc. has agreed to pay $37.5 million to settle claims that it violated Facebook users’ privacy with its location-tracking technology.
Facebook users asked a federal judge in California on Monday to sign off on the class-action settlement, which requires the funds to be distributed to class members on a pro rata basis.
Meta was accused of violating its privacy policy by collecting, storing and monetizing the location data of users who had location services turned off on their mobile devices.
Facebook users argued that Meta used the location data it collected to benefit its targeted advertising campaigns.
The Meta settlement will benefit individuals who used Facebook in the US between January 30, 2015 and April 18, 2018, and whose location data was collected by Facebook regardless of whether they turned off their location services for the Facebook app.
Facebook users speculate that the deal could have as many as 70 million suitors
The lead plaintiffs in the class action have speculated that the number of eligible claimants could reach as many as 70 million consumers.
“Assuming a class size of approximately 70 million users, the settlement amount represents 53% of what plaintiffs could have recovered under a nominal damages theory based on a $1 judgment per class member,” Facebook users said. , in their motion for preliminary approval.
Meta previously attempted to dismiss the class action, at which time the Facebook users amended the complaint to include a breach of contract claim, Law360 reports.
In 2020, a federal judge in California dismissed a pair of complaints arguing that Facebook had violated the law by claiming that tracking the mobile location data of its users without their consent.
